CUSTOMER ACKNOWLEDGMENT: By placing an order, authorizing work, making payment, or accepting delivery of materials, Customer agrees to Rolling Rock Stone’s Terms and Conditions printed below (or available at www.RollRock.com). Customer acknowledges that cutting, alteration, installation, or use of materials constitutes final acceptance of the product and its condition.
- Quotes and Orders. Quotes are valid for 14 days unless otherwise stated. Inventory, lead times, and availability may change. Materials are not reserved until Rolling Rock Stone accepts the order. Special Order Items are subject to a non-refundable 50% first payment.
- Natural Stone. Natural stone inherently varies in color, shade, texture, size, thickness, cleft, veining, and surface characteristics. Samples, photographs, displays, and renderings are representative only. Natural stone may contain fissures, pits, seams, mineral deposits, or other naturally occurring features that are not defects. Variations may occur between individual pieces and pallets of the same product. Customer and its installers are responsible for inspecting all materials before installation and blending materials from multiple pallets and crates during installation to achieve the intended visual range and appearance. Failure to blend materials during installation may result in noticeable color, shade, texture, or tonal variation and shall not constitute a product defect. Customer is responsible for approving product suitability and ordering sufficient additional material for cutting, fitting, selection, and breakage (typically 5%-15%).
- Pickup, Delivery, and Risk. Unless otherwise agreed in writing, all sales are F.O.B. Rolling Rock Stone’s Boyertown, Pennsylvania facility. For Customer pickup or transportation by a carrier selected by Customer, title and risk of loss pass to Customer when materials are loaded for transport. Rolling Rock Stone is not responsible for transit damage and may refuse to load any vehicle it determines to be unsafe, overloaded, or improperly equipped. For deliveries performed by Rolling Rock Stone, title and risk of loss pass to Customer upon delivery of the materials to the nearest safe and accessible unloading point designated by Rolling Rock Stone. Customer is responsible for providing safe site access and unloading conditions and for any damage to driveways, landscaping, utilities, underground improvements, or other property resulting from delivery vehicles entering or operating at the delivery site as directed by Customer. Rolling Rock Stone may refuse delivery or unloading where conditions are unsafe. Delivery dates are estimates and are not guaranteed.
- Inspection, Claims, and Returns. Customer must inspect all materials before cutting, alteration, or installation. Claims for shortages, incorrect products, or visible product damage must be submitted in writing with photographs within 48 hours of pickup or delivery. Custom Fabrications and Special Order Items are non-returnable. Approved returns of unopened stocked accessories are subject to a minimum 20% restocking fee.
- Installation and Safety. Rolling Rock Stone supplies materials only and is not responsible for design, engineering, installation, code compliance, cleaning, sealing, or maintenance. Customer and its contractors are solely responsible for product suitability, proper installation, and compliance with all applicable laws, codes, and safety requirements. Cutting, grinding, drilling, or otherwise working with stone may generate hazardous crystalline silica dust. Appropriate wet-cutting methods, dust-control measures, ventilation, and personal protective equipment must be used. Rolling Rock Stone does not recommend the use of chemicals, cleaners, sealers, salt, or deicers on natural stone. Rolling Rock Stone is not responsible for damage, deterioration, staining, discoloration, or other adverse effects resulting from the use of chemicals, cleaners, sealers, salt, deicers, maintenance practices, installation methods, or workmanship.
- Warranty, Liability, Payment, and Law. EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY SIGNED BY ROLLING ROCK STONE, ALL MATERIALS ARE SOLD “AS IS,” AND ROLLING ROCK STONE DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Rolling Rock Stone’s sole obligation and Customer’s exclusive remedy shall be, at Rolling Rock Stone’s option, replacement of the affected materials or refund of the purchase price paid for the affected materials. Rolling Rock Stone’s maximum liability shall not exceed the amount paid for the affected materials. Rolling Rock Stone shall not be liable for labor, removal, reinstallation, freight, project delays, lost profits, or any incidental, indirect, special, punitive, or consequential damages. Claims for shortages, incorrect products, or visible product damage must be reported within 48 hours as described above. All other claims relating to the materials must be brought within one (1) year of delivery. Customer is responsible for all applicable taxes and collection costs. Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum lawful rate. These terms are governed by Pennsylvania law, and any legal action must be brought in the state or federal courts serving Berks County, Pennsylvania.
